Welcome to Amber’s Creations. By accessing our website, creating an account, or purchasing a product from our store, you agree to these Terms of Service. Please read them carefully before completing a purchase.

1. GENERAL

Amber’s Creations provides digital designs, digital downloads, custom artwork, and other products as described in individual product listings.

By using our website or purchasing from our store, you agree to comply with these Terms of Service and any policies or licensing terms applicable to your purchase.

We reserve the right to update or modify these terms at any time. Changes become effective when posted to our website.

2. DIGITAL PRODUCTS

Most products sold by Amber’s Creations are digital products delivered electronically. No physical product will be shipped unless the product listing specifically states otherwise.

Digital products may include:

• PNG files
• Sublimation designs
• Tumbler wraps
• Seamless patterns
• Mascot and sports designs
• Word art
• Custom digital artwork
• Other downloadable files

Customers are responsible for confirming that their software, equipment, and devices are compatible with the file type being purchased.

3. DIGITAL SALES & REFUNDS

Digital purchases are final sale due to the nature of electronically delivered products.

Please carefully review the product description, images, file specifications, customization details, and licensing information before purchasing.

Refunds, cancellations, duplicate purchases, defective files, and download issues are governed by our Refund & Digital Product Policy.

4. CUSTOM DESIGNS

Customers ordering custom designs are responsible for providing complete and accurate information, including:

• Names and spelling
• Wording
• Team or school names
• Mascots
• Colors
• Sayings
• Other requested customization details

Amber’s Creations is not responsible for errors caused by incorrect information provided by the customer.

Custom designs generally require 2–3 business days unless otherwise stated in the product listing.

Any rush-order availability and applicable fees must be confirmed with Amber’s Creations before an order is placed.

5. DESIGN PROOFS & APPROVALS

When applicable, a proof or preview may be provided for custom designs.

Customers are responsible for carefully reviewing all spelling, names, colors, wording, and customization details before approving a proof.

Once a design has been approved, additional changes may require an additional fee and may not always be possible.

If Amber’s Creations makes an error that differs from the approved proof or information provided by the customer, please contact us so the issue can be reviewed.

6. INTELLECTUAL PROPERTY & OWNERSHIP

Purchasing a digital product from Amber’s Creations does not transfer ownership, copyright, or other intellectual-property rights to the customer.

Artwork and original designs created and owned by Amber’s Creations remain the property of Amber’s Creations. Third-party trademarks, logos, characters, photographs, or other intellectual property remain the property of their respective owners.

Your purchase provides only the usage rights specifically permitted by the license associated with the product.

7. PERSONAL & COMMERCIAL USE

Files designated for personal use may only be used for permitted personal projects.

Commercial use is permitted only when specifically included with the product or when the appropriate Commercial/Small Business License has been purchased.

Purchasing a commercial license does not transfer copyright or ownership of the artwork.

Customers must follow all restrictions, quantity limits, product restrictions, and other conditions stated in the applicable license.

8. PROHIBITED USES

Unless expressly permitted by Amber’s Creations in writing or under the applicable license, customers may not:

• Resell or redistribute the original digital file
• Share, trade, or give away the digital file
• Upload the file to file-sharing websites, groups, drives, or similar services
• Claim the artwork as their own
• Create competing digital products using the artwork
• Sell the artwork as another digital download
• Use the artwork in trademark or copyright registrations
• Use the artwork in violation of applicable laws
• Provide the purchased digital file to another person or business for their independent use

These restrictions apply regardless of whether the file is shared or distributed for free or for payment.

9. DTF PRINTS, SUBLIMATION TRANSFERS & OTHER REPRODUCTIONS

A standard personal-use purchase does not give the customer permission to sell DTF transfers, sublimation transfers, printed transfers, or other reproductions of an Amber’s Creations design.

If a specific Commercial/Small Business License permits the sale of transfers or similar products, the customer must purchase and comply with that license before offering those products for sale.

A commercial license does not permit resale or redistribution of the original digital file unless expressly stated in the applicable license.

10. THIRD-PARTY TRADEMARKS, SCHOOLS & TEAMS

Some designs may reference schools, sports teams, mascots, organizations, names, logos, or other third-party intellectual property.

Purchasing a design from Amber’s Creations does not grant ownership of or additional rights to third-party trademarks, copyrights, logos, or other intellectual property.

Customers are responsible for ensuring that their intended use complies with applicable copyright, trademark, licensing, and other intellectual-property laws.

11. CUSTOMER-SUBMITTED CONTENT

When providing photographs, logos, artwork, names, wording, or other materials for a custom order, you represent that you have the necessary permission or rights to provide and use those materials.

Customers are responsible for ensuring that submitted materials do not violate another person's copyright, trademark, privacy, publicity, or other legal rights.

12. PRODUCT INFORMATION & COLORS

We make reasonable efforts to accurately display product descriptions, images, colors, pricing, file information, and other details.

Colors may vary depending on the customer's screen, monitor, printer, ink, material, software, or other equipment.

Amber’s Creations may correct errors, update information, or modify product offerings when necessary.

13. PRICING, PAYMENT & ORDERS

Prices may change without notice.

Customers agree to provide accurate billing and payment information. Orders will not be processed until required payment has been successfully received.

Amber’s Creations reserves the right to refuse, limit, or cancel an order when reasonably necessary, including suspected fraud, unauthorized activity, pricing errors, listing errors, or violations of our policies.

If Amber’s Creations cancels an order for which payment has already been collected, any amount eligible for return will be refunded to the original payment method.

14. WEBSITE & ACCOUNT USE

Customers may not use our website for unlawful purposes, interfere with its operation, attempt unauthorized access to accounts or systems, or misuse customer or website information.

If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity occurring through your account.

15. THIRD-PARTY SERVICES

Our website may use third-party providers for services including payment processing, digital delivery, website functionality, analytics, shipping, or other business operations.

Use of third-party services may also be subject to those providers' own terms and privacy policies.

16. COMPATIBILITY

Customers are responsible for confirming that their software, equipment, printers, cutting machines, operating systems, and other devices can use the file type being purchased.

Amber’s Creations does not guarantee compatibility with every device, printer, cutting machine, software program, or operating system.

17. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Amber’s Creations will not be liable for indirect, incidental, special, or consequential damages arising from the use or inability to use our website, products, or digital files.

Amber’s Creations is not responsible for problems caused by equipment, software, printers, cutting machines, devices, programs, or other systems outside our control.

Nothing in these Terms is intended to exclude or limit rights or liabilities that cannot legally be excluded or limited.

18. TERMINATION

Amber’s Creations reserves the right to restrict or terminate access to our website, products, or services when a customer violates these Terms of Service, licensing terms, or applicable laws.

Termination does not eliminate obligations or restrictions that arose before termination, including applicable intellectual-property and licensing restrictions.

19. GOVERNING LAW

These Terms of Service are governed by the laws applicable to Amber’s Creations and its operations, without regard to conflict-of-law principles.
